Welcome to Heksia!

These Terms of Service ("Terms") govern your access to and use of the Heksia platform, including:

• Our public website (https://heksia.io)
• Heksia Back Office — business dashboard (https://app.heksia.io)
• The Heksia POS application

Operator

The Heksia platform is operated from the Republic of Cyprus by Kirill Osadchii ("Heksia", "we", "us", "our"). You can contact us at support@heksia.io.

By using any part of the Heksia platform, you agree to be bound by these Terms. If you do not agree, you may not use our services.

Definitions

• "Platform" means the Heksia website, Heksia Back Office, and the Heksia POS application.
• "Account" means the user account you create to access the Platform.
• "Subscription" means a paid plan that provides access to paid features of the Platform for a billing period.
• "User Content" means any data or content you submit to, upload to, or generate through the Platform (including business and transaction-related data).

1. Use of the Platform

• You may use the Platform only for lawful business purposes.
• You must not use the platform for any illegal, harmful, or abusive activities.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must not attempt to gain unauthorized access to other accounts or data.
• You must not interfere with or disrupt the Platform (including by introducing malware, excessive automated requests, or attempting to bypass security measures).
• You must not reverse engineer, decompile, or otherwise attempt to extract source code from the Platform, except to the extent such restriction is prohibited by applicable law.

2. Account Registration

• To use Heksia Back Office or the POS App, you must register an account and provide accurate information.
• You are responsible for all activity under your account.
• You agree to notify us immediately of any unauthorized use of your account.

3. Intellectual Property

• All content, branding, code, and materials on the platform are the property of Heksia or its licensors.
• You may not copy, reproduce, distribute, or modify any part of the platform without prior written permission.

4. Payments and Subscriptions

• Heksia is provided as a subscription-based software-as-a-service (SaaS).
• Paid features are billed in advance on a recurring basis (monthly or annually), depending on the selected plan.
• Prices, billing cycles, and available plans are displayed on our pricing page.
• All payments are processed by our authorized payment provider (Paddle).
• You authorize us to charge applicable subscription fees, taxes, and renewals using your selected payment method.
• Unless stated otherwise, prices are exclusive of applicable taxes (such as VAT), which may be added where required by law.
• If a payment fails or is reversed, we may suspend or limit access to paid features until payment is successfully completed.
• We may change our prices and plans from time to time. If a change applies to your Subscription, we will provide reasonable notice (for example, via the Platform or email) before it takes effect.

5. Submissions and User Content

• Any information submitted via forms (e.g. contact or support) may be used to contact you or respond to your inquiry.
• You confirm that all information you submit is accurate and does not violate any rights.
• You retain your rights in your User Content. You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit, and display your User Content solely to provide, maintain, and improve the Platform.
• You are responsible for your User Content and for ensuring you have all necessary rights and permissions to submit it to the Platform.

6. Availability and Updates

• We strive to keep the platform available, but we do not guarantee uninterrupted or error-free access.
• We may update or modify parts of the platform at any time, with or without notice.

7. Limitation of Liability

• Heksia is provided "as is" and "as available".
• We are not liable for any indirect, incidental, or consequential damages resulting from your use of the platform.
• In no event shall our total liability exceed the amount paid by you (if any) for using our services.

8. Refunds and Cancellation

Refunds

• Customers may request a full refund within 14 days of the initial subscription purchase if they are not satisfied with the service, in accordance with applicable consumer protection laws.
• Refunds are not available for renewal payments, partial subscription periods, or unused time, except where required by law.
• To request a refund, customers must contact us at support@heksia.io.
• Approved refunds will be issued to the original payment method.
• We reserve the right to refuse refund requests in cases of abuse, fraud, or violation of these Terms.

Cancellation

• Subscriptions may be cancelled at any time.
• Upon cancellation, access to the service will remain active until the end of the current billing period.
• No refunds are provided for unused time after cancellation, except where required by law.

9. Third-party Services and Links

Our platform may contain links to or integrations with third-party services. We are not responsible for their content, availability, or privacy practices.

10. Termination

• We may suspend or terminate your access if you violate these Terms or use the platform in an abusive or illegal way.
• You may stop using the platform at any time.
• Upon termination or suspension, you may lose access to your Account and User Content. We may delete your User Content in accordance with our retention practices, unless we are required to retain it by law.

11. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with the new revision date. Your continued use of the platform constitutes acceptance of the updated Terms.

12. Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the platform, you agree to the processing of personal data in accordance with that policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of laws principles.

The courts of the Republic of Cyprus shall have jurisdiction over disputes arising out of or relating to these Terms, subject to any mandatory rights you may have under applicable law.
